Rental Terms & Conditions
1. Limitation of Liability and Assumption of Risk
The Renter acknowledges that the use of mobility equipment (including but not limited to wheelchairs, Transport Chairs, hospital beds, air mattresses and rollators) carries inherent risks.
Assumption of Risk:Â The Renter voluntarily assumes all risks of personal injury, death, or property damage arising from the use or possession of the equipment.
Indemnification:Â ABC Home Mobility, its owners, and employees shall not be held liable for any direct, indirect, or consequential damages or injuries resulting from the use, operation, or malfunction of the rental equipment.
Proper Use:Â The Renter agrees to use the equipment only for its intended purpose and in accordance with any provided instructions or weight capacities.
2. Equipment Damage and Replacement Policy
All equipment is inspected before delivery/pickup and is confirmed to be in good working order.
Damage Charges:Â If the equipment is returned damaged (beyond normal wear and tear), the Renter agrees to pay the full cost of repairs.
Replacement Cost: In the event that the equipment is lost, stolen, or damaged beyond economical repair (as determined by ABC Home Mobility), the Renter shall be charged the full current retail replacement cost of the equipment.
Authorization:Â The Renter authorizes ABC Home Mobility to charge the credit card on file for any such repair or replacement costs immediately upon discovery of the damage.
3. Equipment Condition and Maintenance
The Renter is responsible for maintaining the equipment in a clean and sanitary condition.
The Renter shall not attempt to repair or alter the equipment without written consent from ABC Home Mobility.
4. Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
